1. Agreement to Terms
By accessing or using the Landworx Excavating & Trucking LLC website (landworxexcavating.com) or contracting our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this website or engage our services.
2. Services Provided
Landworx Excavating & Trucking LLC provides excavation, site preparation, septic system installation, grading, drainage, land clearing, and material hauling services to residential and commercial properties in coastal Alabama.
All services are subject to availability, scheduling, weather conditions, and site-specific factors that may affect project timelines and scope.
3. Service Area and Licensing
We operate primarily in Baldwin County, Alabama, with extended coverage in Mobile County and the Pensacola, Florida area.
Important Limitations:
- Septic system installation services are only available in Alabama
- We are not licensed to perform septic work in Florida
- Septic installation is limited to gravity flow systems up to 15,000 gallons per day
4. Estimates and Pricing
Estimates provided by Landworx are based on information available at the time of assessment. Final pricing may vary due to:
- Unforeseen site conditions discovered during work
- Changes in project scope requested by the client
- Soil conditions, underground utilities, or other hidden obstacles
- Weather delays or other factors beyond our control
All estimates are valid for 30 days from the date of issue unless otherwise specified.
5. Project Terms and Deposits
A deposit is required to schedule work and secure your project timeline. Deposit amounts vary based on project size and scope and will be specified in your estimate.
Deposits are non-refundable once work has been scheduled and equipment/materials have been allocated to your project.
6. Payment Terms
Payment terms will be outlined in your project estimate. We accept payment by check, cash, or electronic transfer.
Final payment is due upon project completion unless alternative arrangements have been agreed upon in writing.
7. Site Access and Conditions
The client is responsible for:
- Providing clear access to the work site
- Ensuring utilities are marked before excavation begins
- Obtaining necessary permits (unless otherwise agreed)
- Disclosing known site conditions that may affect the work
Landworx is not responsible for damage to unmarked utilities, septic systems, or underground infrastructure not disclosed prior to work beginning.
8. Permits and Inspections
Unless otherwise agreed in writing, clients are responsible for obtaining necessary permits for excavation, septic installation, and site work.
We will coordinate with local authorities and inspectors as needed, but final permit responsibility lies with the property owner.
9. Weather and Delays
Excavation and site work is weather-dependent. Project timelines may be extended due to rain, flooding, or ground conditions that prevent safe operation of equipment.
Landworx is not liable for delays caused by weather, site conditions, permitting delays, or other factors beyond our reasonable control.
10. Changes to Scope of Work
Any changes to the agreed-upon scope of work must be approved in writing and may result in additional charges. We will provide updated pricing for scope changes before proceeding with additional work.
11. Warranties and Guarantees
We stand behind the quality of our work. If issues arise due to our workmanship, we will address them promptly.
However, we are not responsible for:
- Failures due to acts of nature, flooding, or extreme weather
- Issues caused by work performed by other contractors after our work is completed
- Damage caused by improper site maintenance or use after project completion
- Soil settling or movement beyond normal and expected ranges
12. Limitation of Liability
To the fullest extent permitted by law, Landworx Excavating & Trucking LLC’s total liability for any claim related to our services shall not exceed the total amount paid by the client for the specific project in question.
We are not liable for indirect, incidental, or consequential damages arising from our services.
13. Insurance
Landworx Excavating & Trucking LLC is insured and bonded. Proof of insurance is available upon request.
14. Governing Law
These Terms of Service are governed by the laws of the State of Alabama. Any disputes arising from these terms or our services shall be resolved in the appropriate courts of Baldwin County, Alabama.
15. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes may be submitted to mediation before pursuing legal action.
16. Website Use
The content on this website is provided for informational purposes only. We make no guarantees about the accuracy, completeness, or timeliness of information on this site.
Users may not use this website for any unlawful purpose or in any way that could damage, disable, or impair our systems.
